Guidelines For Custody
WELCOME to Cuyahoga County Juvenile Court's forms for Custody.
These forms are offered with the proviso that although you have a right to represent yourself, we recommend that you retain an attorney experienced in the practice of Juveniles.
If you are representing yourself, you will still have to become knowledgeable of the applicable Ohio Rules of Civil Procedure, all applicable statutory laws, and the Local Rules of Court.
Application Requirements
Birth Certificate - for correct spelling of child's name and date of birth correct spelling of mother's name (and possibly father and parents' date of birth)
Social Security Card - for court
records, have about 6 foreign cases per year without ssn
Paternity
- so father's legal rights have been established, extended family rights vest
Application to Determine Custody/Visitation Packet - to start the case
UCCJEA Affidavit - as required by statute
Intake Sheet - in order for intake worker to do a JIMS screen in order to provide the correct forms to the public, to prevent new cases from being created when old cases exist
Motion Requirements
Motion - to reopen previous case to change court order
Memorandum w/ affidavit - as required by Juv.R. 19
Paternity - in case information is not in the court file already
UCCJEA Affidavit - as required by statute
Intake sheet - in order for intake worker to do a JIMS screen in order to provide the correct forms to the public, to prevent new cases from being created when old cases exist
Parenting Time and Holiday Schedules:
These forms were drafted in conformity with the Standard Visitation Guidelines adopted by the Juvenile Court and proposed Local Rule 29: Parenting Time/Shared Parenting. Use of these forms will not guarantee Court approval, because the Court will review any agreements to ensure that the proposed schedules are in the child's best interest.
Parenting Time/Shared Parenting Agreement - This form is used to establish a fixed schedule and the guidelines governing the child's time with both parents.
Parenting Time/Shared Parenting Holiday Schedule - This form may be used to supplement the Parenting/Shared Parenting Agreement when the family celebrates Holidays other than those listed in that agreement.
